Statutory Declaration of Non-Impediment, also known as Single Status Affidavit, is a sworn statement made by the individual. In the affidavit the applicant states their biographical facts and marital status. (Single, divorced, widowed) The single affidavit is a free-form letter. The applicant may draft it, download a sample from the web or use DOXNOW to get the affidavit prepared. Some countries have specific requirements to the information in the affidavit and subsequent apostille and attestation procedures. If the document is going to "Hague" Country then you will need an single status affidavit apostille or statutory declaration apostille, and Embassy Attestation is a must for "Non-Hague" Countries.
The single status affidavit is signed in front of the notary, US Military Notary or US Consular Officer, notarized and then it is ready for the authentication.
Many countries accept the self-declaration as valid proof of marital status. However, some countries do not.
Based on our experience Single Status Affidavit is accepted in Argentina, Brazil, Russia, Netherlands, Aruba, Cuba, Germany, Mexico, Colombia, Chile, Panama, India, China, Vietnam, Austria, Kazakhstan, Georgia, Dominican Republic, Armenia, Finland, Egypt, Spain, and Portugal.
In cases when the Statutory Declaration is not considered valid proof of marital status, the Certificate of No Record of marriage must be obtained. This is an official government issued document, which will confirm that the individual in question is not married within the jurisdiction of the said government office. However, the jurisdiction of such offices are limited in most US States to one county, and rarely to one state. Nationwide marital status check is not available in the United States. So far, we are aware that Norway, Iceland, Israel, Estonia, and Belarus will not accept Single Status Affidavit and will require certificate of civil status from local US government offices.
SINGLE STATUS AFFIDAVIT APOSTILLE
For apostille purposes the statutory declaration must be duly signed and notarized. Some countries do not consider Statutory Declaration of Single Status as valid proof of your eligibility to marry. In such cases, we recommend to order Certificate of No Marriage Record Apostille.
Certificate of No Record of Marriage is different from Single Status Affidavit. No Record of Marriage is a Civil Status document issued by a government agency which states that the person has no Marriage Record in the specific jurisdiction.
